DWI Checkpoints Not Headed To Texas

The regular session of the 81st  Texas Legislature ended this week and I will be providing a more complete list of criminal laws that passed, but I wanted to mention one that was previously discussed on this blog.  Luckily, for the citizens of Texas this legislature did not pass the bill allowing DWI checkpoints in Texas. If you have questions regarding a DWI please contact our law firm at (713) 225-1038.

Luckily, for the citizens of Texas....Lucky? Maybe lucky if you're a drunk drivers, not so lucky for people sharing the roads with them. Maybe not even lucky for the drunk drivers. Getting pulled over may save their lives.

Every weekday night from 10 p.m.-1 a.m., 1 in 13 drivers is drunk (BAC of .08 or more). Between 1 a.m.- 6 a.m. on weekend mornings, 1 in 7 drivers is drunk. Think about those numbers next time you're on the road at night and then ask yourself if you feel lucky. It's real simple - if you're going to drink...don't drive. If you have to drive...don't drink. Be personally and socially responsible.

As of December 2009 I have read the passing of a vote in favor of check points which needs to be further ratified by the state/senate?. Is there further and updated info on this?

And to Kay Elliott, stay off the road at night if you are so worried about it first of all. Secondly, I am a social drinker and know that I take 5 beers in an hour with food to get to .08, but I don't want some cop sticking his big snoot in my car asking that incriminating question " have you been drinking sir". Of course I have been drinking, prohibition ended in the 1930's, but I'm not drunk and below .08. However, this still means I have to get out of the car, go thru a bunch of crap and be harassed, delayed etc. and this I say B.S. Unconstitutional. You give up your rights and you have nothing.
